LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

2. Acknowledgment of Risks
I understand that participation in activities at Clermont RC, including but not limited to use of RC tracks, pit areas, driver stands, walking areas, parking areas, spectator areas, swap meets, classes, lessons, practice sessions, races, events, demonstrations, and related activities (collectively, the “Activities”), involves inherent and other risks.
These risks may include, without limitation:
I understand that these risks may arise from known or unknown conditions and may occur even if reasonable care is used.
3. Assumption of Risk
I voluntarily choose to participate in the Activities and freely and knowingly assume all risks, whether known or unknown, inherent or otherwise, associated with my presence at or participation in the Activities, including the risk of personal injury, death, illness, and property damage.
I understand that I am responsible for my own conduct, my own equipment, and my own safety, and that I participate entirely at my own risk.
4. Release and Waiver of Claims
In consideration for being allowed to enter, attend, observe, or participate in the Activities, I, on behalf of myself and my heirs, beneficiaries, estate, personal representatives, successors, assigns, and anyone claiming through me, hereby release, waive, discharge, and covenant not to sue:
Clermont RC, its owners, officers, members, managers, employees, volunteers, agents, event organizers, sponsors, vendors, contractors, affiliates, landowners, property managers, and all other persons or entities acting in any capacity on its behalf (collectively, the “Released Parties”),
from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses of any kind, whether known or unknown, arising out of or related in any way to my entry onto the property, attendance at the facility, or participation in the Activities, including claims for personal injury, death, illness, property damage, or theft.
This release is intended to be as broad and inclusive as permitted by Florida law.
5. Release for Negligence
I specifically understand and agree that this waiver and release applies to claims based on the ordinary negligence of any Released Party, to the fullest extent permitted by law.
I understand that by signing this document, I am giving up important legal rights, including the right to make a claim or file a lawsuit against any Released Party for injuries, damages, or losses resulting from the ordinary negligence of any Released Party.
This waiver does not release claims that cannot be waived under applicable law, including claims for gross negligence or intentional misconduct to the extent prohibited by law.
6. Rules, Safety, and Removal
I agree to follow all Clermont RC rules, posted signs, verbal instructions, event procedures, and safety requirements at all times.
I understand that Clermont RC may deny entry, stop my participation, remove me from the property, or revoke privileges at any time for unsafe conduct, rule violations, disruptive behavior, intoxication, or conduct that may endanger others or the facility.
I understand that no refund is required if I am removed for violating rules or behaving unsafely.
7. Participant Responsibility for Equipment
I accept full responsibility for the condition, operation, charging, fueling, transport, storage, and use of my RC vehicles, batteries, chargers, fuel, tools, tables, trailers, and any other personal property I bring onto the property.
I understand that I am solely responsible for ensuring my equipment is safe and properly maintained.
I agree that Clermont RC is not responsible for any loss, theft, or damage to my personal property.
8. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
9. Medical Authorization
If I am injured or require medical attention, I authorize Clermont RC and its representatives to seek emergency medical care for me if deemed appropriate, understanding that they have no obligation to do so.
I accept full responsibility for any medical costs, ambulance charges, hospital charges, or related expenses incurred on my behalf.
10. Photo / Video Release
I grant Clermont RC the right to photograph, video record, and otherwise capture my likeness, name, voice, vehicle, and participation during the Activities, and to use such materials for lawful promotional, advertising, social media, website, or other business purposes, without compensation.

11. Spectators / Guests
I understand that this waiver applies whether I am racing, practicing, working in the pits, spectating, helping another participant, attending a swap meet, or otherwise present on the property in connection with the Activities.
I agree that I am responsible for any guest I bring onto the property and for ensuring that guest follows all rules and signs any required waiver.
12. Minor Participants
If I am signing for a minor, I represent that I am the minor’s natural guardian, legal guardian, or otherwise legally authorized to sign on the minor’s behalf.
I consent to the minor’s participation in the Activities and acknowledge that the Activities involve inherent risks.
To the fullest extent permitted by Florida law, I waive and release, on behalf of the minor and on my own behalf, any claim or cause of action against the Released Parties arising from the inherent risks of the Activities. Florida law specifically authorizes natural guardians to waive and release, in advance, certain claims for a minor arising from the inherent risks of a commercial activity if the statutory warning language is used.
REQUIRED FLORIDA WARNING FOR MINORS
BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM CLERMONT RC AND THE OTHER RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND CLERMONT RC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

13. Health and Fitness Representation
I represent that I, and any minor for whom I sign, am physically and mentally able to safely participate in the Activities, or I knowingly accept the risks of participation despite any condition that may affect safety.
14. No Reliance / Entire Agreement
I am not relying on any oral statement or representation not contained in this document. This document contains the entire agreement between me and Clermont RC regarding liability waiver, release, and assumption of risk for the Activities.
15. Severability
If any part of this document is held invalid or unenforceable, the remaining portions shall remain in full force and effect.
16. Governing Law and Venue
This Agreement shall be governed by the laws of the State of Florida. Any dispute relating to this Agreement or the Activities shall be brought exclusively in a court of competent jurisdiction in Lake County, Florida, unless applicable law requires otherwise.
17. Knowing and Voluntary Signature
I have carefully read this entire document. I understand its contents and understand that I am giving up substantial legal rights by signing it. I sign this document freely and voluntarily.
